dc.description.abstract | This article discusses the likely Supreme Court invalidation of the disparate-impact test as a means for proving a violation of the Fair Housing Act. It analyzes the arguments of the competing sides in support of and opposed to continued use of the disparate-impact test, in particular the arguments of fair housing advocates, HUD, and the banking and insurance industries. It concludes that the disparate-impact test remains an important tool in the continued fight against unfair and unequal housing policies. | |
