dc.description.abstract | This paper will answer the questions: Is mediation a viable alternative to litigation for resolving environmental conflicts and rulemaking in public administration? If so, under what circumstances is it best to use mediation? The introduction will explain what mediation is, its advantages and disadvantages, and the circumstances that is best to use this alternative. Finally, cases studies for both mediation and litigation will be compared and contrasted in order to show the effectiveness and shortcomings of mediation. Finally, this paper will conclude that environmental mediation can be an effective alternative under the right conditions. | |
